1. Operator and service
These terms govern ZoraForms, an online service for receiving HTML forms, storing submissions, handling conversations and configuring integrations. The operator is Codedream Norbert Jańczak, whose full details appear above. Businesses and consumers may use the service; someone acting for a business must be authorised to represent it.
The documentation and the offer describe available functions. Payments require Stripe; sending mail requires SMTP and receiving ordinary replies requires operator-configured IMAP. Registration requires configured email and bot protection. This service is not designed for medical data, passwords, full payment-card details or life-critical information.
2. Accounts and contracting
A current browser, internet connection, email address and necessary cookies are required. Website forms need a correct HTML/JavaScript integration and security configuration. The free account contract starts when the terms are accepted and an account is created. Paid service starts following verified payment under the offer shown before purchase.
Keep account details accurate and protect passwords, tokens and recovery codes. Optional two-factor authentication is recommended. Acceptance includes the data processing terms where the operator processes personal data on your instructions. Acknowledging the privacy notice is not marketing consent. Registration records the accepted document version and time; acceptance is not retrospectively invented for existing accounts.
3. Plans and payments
Free has no charge. Current prices and limits appear in pricing and before purchase: Start PLN 29, Growth PLN 79 and Pro PLN 199 per month. The offer shown before contracting is binding. The first payment is taken at purchase and renewals follow the monthly subscription period. The payment provider displays the total payable and applicable tax information before confirmation.
Cancel the next renewal through the billing portal when available, or by contacting the operator. Cancellation normally retains access until the paid period ends; separate withdrawal, complaint and refund rights remain. Failed payment may restrict paid features once entitlement expires. Existing data remains readable/exportable within its retention period.
Monthly quotas follow UTC. Deleting a submission does not restore usage. Free requires domain verification; multiple accounts or misuse of domains to evade limits are prohibited. A new advertised price does not automatically amend an existing contract. Price changes for existing customers require advance notice, a valid contractual basis and an opportunity to cancel before taking effect.
4. Your data and responsibilities
You retain rights to your data and grant only the processing rights necessary to provide the service. You determine lawful purposes, legal grounds, fields and notices for your forms, and choose SMTP/CC recipients, webhook destinations and MCP permissions. We do not use submission content for advertising or training our own AI models.
You are responsible for your website, receiving URL, origins, CAPTCHA, external destinations and exported copies. Do not collect unnecessary or special-category data without separate agreement. Retention is assigned when a submission is accepted; deletion or expiry may permanently remove content. Independently delivered copies require separate management.
Spam, phishing, unlawful content, infringement, bypassing safeguards, infrastructure abuse and malware are prohibited. Use only domains and data you are legally entitled to use.
5. Availability, maintenance and suspension
We maintain the service with due care. Without a separate SLA, no uninterrupted availability, fixed support response time, elimination of all spam or universal delivery by external email providers is promised. This does not remove the obligation to deliver a conforming service. Significant planned maintenance is communicated reasonably in advance.
Access may be proportionately restricted for a real security threat, legal requirement, serious breach or abuse. Where possible we explain the reason and allow remediation first. Urgent action may precede notice, which follows without undue delay. Suspension does not automatically forfeit payments or complaint rights.
External outages or events beyond reasonable control require mitigation and appropriate response; they do not generally exclude responsibility for the operator's own failures.
6. Planned closure of the project
We may discontinue ZoraForms for important reasons, including sustained economic unviability, business closure, inability to maintain infrastructure safely or legal changes preventing operation. Planned closure will be announced at least 60 days ahead by email to the account and a service notice, with the date, export instructions and contact details.
Until that date you can export retained submissions to CSV/JSON, with assistance for technical limitations. Normal retention still applies; a closure notice does not extend each submission's lifetime. No charges will cover time after closure, and any prepaid unused period will be refunded proportionately, without prejudice to stronger legal rights.
Data will be returned or deleted under the processing terms and legal duties. A shorter notice is permitted only where law or an immediate serious threat makes safe operation impossible. We notify without undue delay, assist recovery where possible and settle unused payments.
7. Liability
Only for business customers without statutory consumer protection, contractual damages are limited to direct actual loss and the total fees paid in the 12 months before the event, with a minimum cap of PLN 500. Lost profits and indirect losses are excluded only insofar as law permits.
Those limits do not apply to consumers or businesses enjoying statutory consumer protection. They do not cover intentional wrongdoing, gross negligence, personal injury, refunds of undue/unused payments, or liability that law cannot restrict, including individuals' GDPR rights. Customers do not assume responsibility for the operator's violations.
Each party remains responsible for its own conduct. Keep exports required for your purposes; we maintain agreed security and backups. Export responsibilities do not excuse data loss caused by our breach.
8. Consumers, withdrawal and complaints
Consumers and eligible protected sole traders retain mandatory distance-contract and digital-service rights. Creating an account, activating service or paying does not automatically waive withdrawal. An online contract may generally be withdrawn from within 14 days by an unambiguous email or letter to the operator; no mandatory form is required.
Receipt is acknowledged. Refunds follow applicable law, generally within 14 days through the original payment method unless a different no-cost method is agreed. No waiver is assumed. Charging for performance expressly requested during the withdrawal period is possible only where all statutory conditions are satisfied.
Send complaints to the stated contact, describing the issue, approximate date and requested remedy, without passwords or unnecessary personal data. We reply within 14 days; law determines the consequence of no reply. Statutory conformity remedies, including bringing the service into conformity and, where applicable, price reduction or termination, remain available. UOKiK provides information on assistance and alternative dispute resolution; participation in a specific procedure is agreed separately.
9. Changes and final provisions
Changes must have concrete grounds such as legislation, security, provider requirements or technical development. Significant changes are explained on a durable medium at least 30 days ahead, with reasons, effective date and an opportunity to cancel beforehand. Longer notice or additional digital-service cancellation rights required by law take priority. Changes are not retroactive and do not automatically alter a paid period's price.
Polish law applies without depriving consumers of mandatory protections under the applicable law of their country. Courts have jurisdiction as provided by law; consumers are not forced to use only the operator's local court. Remaining terms apply independently where a clause is invalid. Save or print these terms; the data processing terms form an integral part.
